The purpose of this "Terms of Use" guideline is to provide a code of conduct when accessing this service. By using this Web site you are agreeing to the Terms of Use, and if you do not agree with the "Terms of Use" please do not use this Web site or its services.
Definitions: the following definitions apply throughout this agreement; the service provider is "Bellaware, inc. and "Bellaware, inc. is the service provider. The term user, client, customer will represent the person, persons, business or any entity using this service.
Code of Conduct: the following is not allowed at any time. You may not transmit any messages that would encourage civil unrest, be abusive defamatory, pornographic, vulgar or obscene or otherwise objectionable material. You may not break any local, state or federal laws, invade the privacy of someone, and use this service to impede the service of others or send bulk mailings.
Liability: The user agrees to indemnify BELLAWARE, INC., its affiliates or associates, from any damages, losses, expenses or costs which Bellaware, Inc., its respective employees, officers, authorized representatives may incur as a result of material entered into this service. Users entering information into this service are solely responsible for its content, up to and including its accuracy. Bellaware, Inc. shall not be liable to any user or anyone else for any inaccuracy, error or omission regardless of the cause or for any damages resulting there from. The service provider shall have no liability to you for any interruption or delay in access to the site.
Submissions: user is responsible for the content of any submission of photos or information. Bellaware, Inc. reserves the right to move, edit and delete any information that, in its sole discretion, deemed to be abusive, obscene, defamatory, or otherwise unacceptable. Any copyright infringements will not be tolerated at any time.
User also understands that submission of false and misleading information may cause your access to this site to be either denied or terminated without notice. The service provider does not knowingly collect personal information from children. If service provider becomes aware that it has collected personal information and or data from a user below the age of eighteen (18), this data, etc will be deleted from its records and will not collect any new data from that equipment. Service provider does not and will not tolerate the transmission of any message that does not accurately identify the sender, sender's return address or e-mail address of origin.
Liability: the service provider is not responsible for any claim, error, omission or inaccuracy in the material on any website hosted by Bellaware, Inc. Each user shall indemnify, defend and hold harmless Bellaware, Inc.,its parent corporation, its affiliates, their officers, employees, agents and website partners, from any and all claims , demands, damages, costs (legal or otherwise), liabilities up to and including reasonable legal fees made by any third party due to or arising out of that user's acts or omissions, up to and including claims arising out of that users use of the service providers site, their submission, posting or transmission of the content or of their violation of the terms.
Personal information: all personal information which the user provides while registering for this service is private and the service provider will not exchange or sell any information to third parties, except as required by subpoena, search warrant, legal process or in the case of imminent physical harm to any customer or others. Also the service provider will take reasonable steps to protect any and all personal information that is submitted.
Mailing list: the service provider from time to time will send out emails to all the users updating the users to new services, options, or changes to the Terms of use. This mailing list is for service provider only and no access will be given to any third party.
Links: for your information and convenience the service provider provides links to other web sites and does not in any way endorse the companies or information found on any linked website. In as much as the service provider does not control the content of those sites, you access the website at your own risk. The service provider reserves the right in its sole discretion to either suspend or terminate any link with third parties or websites it determines are either inappropriate or not consistent with the standards of Bellaware, Inc.
